These Terms of Service ("Terms") govern your use of the digibeats.in website and any services offered by Digibeats IT Solutions ("Digibeats", "we", "us", "our"). By accessing the site or engaging us for services, you agree to these Terms.

1. Services

Digibeats provides IT infrastructure, networking, cybersecurity, managed services, and related consulting. The specific scope, deliverables, fees, and timelines for any engagement will be set out in a separate Statement of Work, Master Services Agreement, or written quotation, which shall prevail over these Terms in case of conflict.

2. Use of the website

You agree not to:

• Use the site in any way that violates applicable law or regulation
• Attempt to gain unauthorised access to any part of the site, server, or related infrastructure
• Introduce viruses, malware, or other harmful code
• Scrape, harvest, or otherwise extract data without express permission
• Use the site to send unsolicited communications

3. Intellectual property

All content on this site — including text, graphics, logos, design, and software — is owned by or licensed to Digibeats and is protected under applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Information shared in the course of an engagement is treated as confidential. Both parties agree to protect the other's confidential information using reasonable care and not to disclose it except as required by law or agreed in writing.

5. Warranties and disclaimers

The site is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Service-specific warranties, if any, will be set out in the relevant engagement contract.

6. Limitation of liability

To the maximum extent permitted by law, Digibeats shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the site. Our total aggregate liability arising out of or related to these Terms shall not exceed the amount paid by you to Digibeats in the twelve months preceding the claim, or, if no fees have been paid, INR 10,000.

7. Indemnification

You agree to indemnify and hold Digibeats harmless from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising out of your breach of these Terms or misuse of the site or services.

8. Third-party services

The site may include links or integrations to third-party services (e.g. form processors, analytics, font providers). Digibeats is not responsible for the content or practices of those third parties; their terms and privacy policies apply.

9. Termination

We reserve the right to suspend or terminate access to the site at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, Digibeats, or third parties.

10. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts at New Delhi.

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Continued use of the site after changes constitutes acceptance.
